At Elliott Barry LLC (“Elliott Barry,” “we,” “us,” or “our”), we are committed to providing high-quality digital marketing services tailored to help your business grow. Our services involve significant investment in strategy development, creative effort, technical expertise, man-hours, and often, third-party platform costs (such as advertising spend).

Due to the nature of these services, the resources allocated, and the costs incurred upon engagement, Elliott Barry LLC maintains a strict non-refundable policy for most fees paid to us. By engaging our services and making payment, you (“Client,” “you,” “your”) acknowledge and agree to this policy.

2. Non-Refundable Fees

The following fees, once paid, are non-refundable under any circumstances:

  • Setup Fees: All one-time setup fees for services such as SEO, PPC campaigns, social media accounts, email marketing platforms, or website development are non-refundable. These fees cover the initial costs associated with research, strategy, account configuration, and resource allocation.
  • Service Retainers & Project Fees: Monthly retainers and payments for project-based work (including but not limited to SEO, Content Marketing, Social Media Management, PPC Management, etc.) are non-refundable. These fees cover the work performed, planned, or allocated for the respective period. Payments made in advance for future periods are also non-refundable once the initial service period commences or work has begun.
  • Hourly Fees: Fees paid for consulting, training, or any work performed on an hourly basis are non-refundable once the work has been performed.

3. Third-Party Costs (Ad Spend & Other Expenses)

Funds provided by the Client to Elliott Barry LLC specifically for payment to third-party platforms – including but not limited to Google Ads, Meta (Facebook/Instagram) Ads, LinkedIn Ads, Bing Ads, software subscriptions, stock media licenses, or other third-party vendors – are strictly non-refundable by Elliott Barry LLC. These funds are transferred to the third parties and are subject to their respective terms and refund policies (which typically do not allow refunds). The Client is responsible for all such third-party costs incurred on their behalf as per the agreed SOW.

4. No Guarantee of Results

As outlined in our Terms of Service, Elliott Barry LLC does not and cannot guarantee specific results or outcomes from our digital marketing services. Factors such as search engine algorithm changes, competitor activities, market conditions, and third-party platform decisions are beyond our direct control. Therefore, dissatisfaction with specific results (such as search rankings, traffic volume, lead quality/quantity, or return on investment) is not grounds for a refund. We commit to providing our expertise and effort as outlined in the SOW, but we do not sell guaranteed outcomes.

5. Service Cancellation

If you choose to cancel your services with Elliott Barry LLC, you must do so in accordance with the termination clause in your Terms of Service or Statement of Work. Upon cancellation:

  • You will be responsible for all fees and costs incurred up to the effective date of termination.
  • No refunds will be issued for any fees paid prior to the cancellation date, including any advance payments for the period in which cancellation occurs.
  • Any outstanding invoices must be paid in full.

6. Exceptional Circumstances & Discretion

While our policy is strictly non-refundable, Elliott Barry LLC values its client relationships. In truly exceptional circumstances, such as a documented, material failure by Elliott Barry LLC to provide a significant, core component of the agreed-upon Services (not attributable to Client delays, lack of cooperation, or external factors), we may, at our sole and absolute discretion, consider offering a partial refund or a service credit for future use. Any such consideration must be requested in writing, detailing the circumstances, and will be reviewed on a case-by-case basis. This clause does not create any obligation or entitlement to a refund.

7. Chargebacks

We encourage clients with billing concerns to contact us directly to resolve any issues. Initiating a chargeback through your bank or credit card company for a valid fee paid under this Agreement is considered a breach of our payment terms. In such cases, Elliott Barry LLC reserves the right to:

  • Immediately suspend all services.
  • Dispute the chargeback, providing evidence of service and agreement.
  • Pursue collection of the owed amount, including any fees incurred due to the chargeback.

8. Policy Acknowledgment

By making a payment to Elliott Barry LLC for any service, you confirm that you have read, understood, and agree to be bound by this Refund Policy.
